Summary

• Submitting an order is a legally binding contract. You will submit only real orders that you will pay for. Orders can not be cancelled.
• Refunds are entirely at our discretion.
• You will provide correct address and telephone numbers.
• We will endeavour to deliver your order within 60 minutes from ordering. This is not a guarantee.
• In case of any problems with your order, we will endeavour to contact you via the details you have specified. We reserve the right to contact you via any method you have registered with us, in case the details you select for an order are insufficient.
• If you have a complaint, you must call us as soon as possible so that we can resolve the issue.

Within this document, "us", "our", and "we" refer to Ken Hoi Company Ltd, 46/50 Kensington Place, St Helier, JE1 1ET, company registration 86984, trading as Man's Garden, Sandybrook Lane, St Lawrence, JE3 1LU. "You", "your" and "user" refer to you, the end user of this website. We offer a Chinese food home delivery or collection service. By registering and placing an order via this website you are agreeing to abide by these terms and conditions. By placing an order you are entering into a legally binding contract, governed by these terms and conditions. You agree to provide us with correct contact information so that we may process your order; information such as your email address, your full address, and your telephone number. You agree that you will never use fake details. You agree to keep your details up to date. You agree that you will not share your account details and allow others to use your account. You may place an order any time we are open, as indicated by the "opening hours" section on the home page. Once you have placed an order, it cannot be cancelled online. You may call us within five minutes of placing the order, but we do not guarantee we will be able to cancel it. If we have started preparing your order, you will be charged for cancellation. We reserve the right to cancel any order at any time, without necessarily giving a reason. If we cancel an order placed by you, we will endeavour to contact you as soon as possible on the telephone number you submitted with the order.

We will endeavour to deliver your order within the time window specified (usually 45 to 60 minutes) but this is not a guarantee. Peak periods, including weekends and bank holidays, may result in an extended delivery time. We will endeavour to contact you if your order is extensively delayed, or if there is an issue with it. We will first try the telephone number you have selected for the order, and may try other numbers and methods that you have provided us with. If your order is under the minimum order value, currently £12, you will be charged a delivery fee. This will show on your order. Orders that are over the minimum order value are delivered for free.

You can pay for your order either 'cash on delivery' or online via credit/debit card. We do not, at any point, handle your credit/debit card data directly - this is done by our payment services provider. All online transactions are handled securely using SSL encryption. All online transactions require CVV2/CVC2 verification (the last three digits on the back of the card. At no stage do we have access to your complete card data. We will store an obscured version of your card data in order to provide receipts. We cannot be held liable for any damage or losses caused by our payment services provider.

We reserve the right to alter these terms and conditions at any time and without any prior notice. We reserve the right to alter or cancel any offer provided by us to you without any prior notice. These terms and conditions are subject to the laws and jurisdiction of the island of Jersey. Disputes arising in connection with our terms and conditions will be subject to the jurisdiction of the Jersey courts exclusively.

Data protection

We store some of your personal information in order to allow you to place orders online. We store details of your name, addresses, telephone numbers, email address, and order history. Your data will be stored and held within the European Union. You may delete your data from your profile page, however to delete your account completely you must contact us on the telephone number listed on the home page.

Privacy policy

We will not share your details outside of our company. We explicitly will not sell, loan, or allow access to your data by third parties. We will take reasonable measures to keep the details you provide us secure, however as with any machine on the internet, there is a risk it could be hacked. At no time do we store your complete credit card data - it is sent directly to our payment services provider. The password you provided us upon registration is only ever stored in an encrypted format. We recommend that you use a unique password, not used anywhere else, to log in to this website.
